Ni perdón ni olvido. Balancing the Right to Be Forgotten With the Right to Truth Through the Collective
This study examines the evolving tensions between the right to be forgotten (RTBF) and the right to truth in the digital era, particularly in the context of European and Inter-American legal frameworks.
This work proposes a novel approach to reconciling these rights by framing the right to truth within the broader category of cultural rights. By analyzing the legal foundations of the RTBF, the evolution of the right to truth, and the defining characteristics of cultural rights, this study argues that information of collective historical relevance should be protected from erasure claims. The implications of this perspective suggest a rethinking of digital memory, balancing personal privacy with the preservation of collective history.
The project’s final aim is to publish the study as an article in a specialized journal in the field.
